Terms of Service

1. The service

Get Payd (Pty) Ltd, trading as Payd ("Payd"), provides software that connects to a subscriber's Xero account and sends automated payment reminders to the subscriber's debtors via WhatsApp. Payd reads accounting data on a read-only basis and never modifies the subscriber's accounting records.

2. Accounts and trials

Subscribers must provide accurate account information and keep credentials secure. New subscriptions include a 14-day free trial; no payment details are required to start a trial. Paid plans are billed monthly in South African Rand at the published prices, and may be cancelled at any time with effect from the end of the current billing period.

3. Subscriber responsibilities

• The subscriber confirms it is lawfully entitled to contact its debtors about amounts owed, and that debtor contact information it connects to Payd is accurate.
• The subscriber remains responsible for the accuracy of its accounting records in Xero, including recording payments, since reminders are based on those records.
• The service may not be used for unsolicited marketing, harassment, or any unlawful purpose.

4. Messaging and opt-outs

Reminders are delivered via Meta's WhatsApp Business Platform and are subject to Meta's policies and message template approval. Any recipient may opt out by replying STOP; Payd honours opt-outs immediately and permanently unless the recipient opts back in. Payd may decline to send messages that would breach applicable law or platform policies.

5. Availability and third parties

Payd depends on third-party services (including Xero, Meta/WhatsApp, and hosting providers) and cannot guarantee uninterrupted availability of those services. Payd will make reasonable efforts to maintain availability and to notify subscribers of material disruptions.

6. Liability

To the maximum extent permitted by law, Payd's aggregate liability arising from the service is limited to the subscription fees paid in the three months preceding the claim. Payd is not liable for indirect or consequential loss, or for outcomes of a subscriber's own credit-control decisions. Nothing in these terms limits liability that cannot be limited under South African law, including under the Consumer Protection Act where it applies.

7. Data protection

Personal information is processed in accordance with our Privacy Policy and POPIA. Where Payd processes debtor information on a subscriber's behalf, it does so as an operator on the subscriber's instructions.

8. General

These terms are governed by the laws of the Republic of South Africa. Payd may update these terms with reasonable notice; continued use after notice constitutes acceptance. Questions: hello@getpayd.co.za.
